ULU goes home pending appeal!

On Friday, April 30, 2010, one day before the hearing on the Writ of Replevin (return our dog) scheduled before Judge Futch on May 3, 2010, the County agreed to return ULU pending appeal.

For those of you who have not been following this case, ULU was impounded by Marion Animal Control on March 30, 2010, based on allegations that he had killed a cat. As a result of the impoundment, we immediately filed a lawsuit containing a Writ of Replevin while also asking for injunctive and declaratory relief. The actual lawsuit in all its incomprehensible legal jargon can be viewed here

Meanwhile, a Dangerous Dog Classification hearing was noticed.  On Tuesday morning, a Notice to Appear the following day was placed on the owner's door.  The case was reset, but only after I had already left to appear.  We never even got a formal notice of the next hearing, and I only heard about it from a witness who called to say that she had been told to appear the next day.

Despite the fact that all the witnesses agreed that the dog was not dangerous, and even the original complainant wanted to withdraw charges, the Dog Classification Board declared ULU dangerous on Wednesday, April 28, 2010.

Next we will be appearing for a new trial on ULU's dangerous dog classification scheduled for May 26, 2010 at 1:30 PM before Judge Steven G. Rogers, Room 507, Marion County Judicial Center, 110 NW 1st Ave, Ocala, FL 34475. The trial is open to the public.

There is a difference between a Dangerous Dog ans a dog that made a mistake because of his instincts.

I have been following this case. When push comes to shove I think ULU is a victim beacause of where his owner works. The county animal services has always had a problem with the Humane Society, I guess because the Humane Society is a no Kill shelter that manages to survive on donations from the public, not our taxdollars/

I Feel sorry for the cat but that is what dogs do......kill cats.

I cant believe Marion county is still doing this.
I have a to still pay six hundred dollars a year to keep my pooch....
Because of a knip on the leg.
Even though the guy said he didnt want any charges....
