State Attorney Declines Prosecution of Shooter

The State Attorney announced this morning that he will not be charging the shooter of Epic and Samson. The full memorandum from the State Attorney can be read here.  It is obviously disappointing to the owners that the criminal justice system cannot "prove a crime was committed."  They can take some solice in the fact that the investigation was re-opened.  But the fact that the shooter, who by all accounts shot the second dog while running away, will walk away without penalty is difficult to bear.

The State Attorney' justification for not filing, is in part based on the fact that the shooter had a right to be outside under Florida Law, despite being told to stay inside by the 911 operator.  The memo "not to file" concedes that the shooter's rationale for going outside because of children was not borne out by the evidence. "The testimony is clear that the only children in the area were inside a screened in porch and were in no danger." However, according to the report, this makes no difference because the shooter had the right to be outside whether children were there or not. The decision not to file is based on F.S. 776.013 which states in part:

A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself

The botton line of the memo? Because the shooter says he was in fear for his life, and his next door neighbors say they were also afraid of the dogs, the shooting was justified. 

The report fails to address in any way, the issue of the shooting of Epic as she ran away. Nor does it even mention there is evidence of this in terms of the witnesses. This is significant, because in the Orlando shooting of the two Huskies by Mr. Comins, the state attorney charged the shooter on the final shot only, where the dog was already down and he turned around and fired.

And, of course, the report fails to address the tone of voice of the shooter as he calls in to announce he will shoot the dogs to the 911 operator, or the chuckling when he calls back and ensures 911 that his gun is put away after he has killed them. The actions taken by the shooter, from the 911 call to the the shooting of Epic in the back, all serve to show the lack of a reasonable fear.  

In any case, the no charging decision has been made, and there is nothing more that can be done at this point to change it.  I am unhappy but not surprised by the State Attorney's decision.  The burden of proof is beyond a reasonable doubt, and none of the lawyers I talked to in Ocala who were in public service would have wanted to go forward with such a case.  There is no upside to a prosecution - if you win it is probably a misdemeanor crime, and if you lose, you have spent prosecutorial resources to no avail.

The owners are considering their options.

This is all a bunch of bull crap as far as I am concerned. Marion County officials do not want to stand up for what is right and they know that this shooter should be charged. File a civil suit with the court system and take this case as far as you can take it. This man will not be laughing when it is over. We are the voices for our precious animals and this has to be stopped. Holli, I commend you for putting up a fight but it is not over by a long shot!! You now have alot of supporters and we are behind you all the way.

In the Commonwealth of Va. you have to be able to justify the use of deadly force. The law is very clear, you cannot shoot something because you're afraid. If you're afraid go somewhere that you feel safe, but don't start popping off rounds, you will go to jail. Now that I know the rules in the state of Fla.; if I find myself in close proximity to Christian Monteiro, I'll have no recourse other than shoot him dead on site as he is a reckless coward, his actions cannot be trusted, I would fear for my life. He is a loose cannon that has ben vindicated. This is the worst kind of criminal, he feels as if he's done nothing wrong. All of you people in Marion Co. with your agressive Jack Russels, Shelties, Labs, ................... and the dreaded Blood Hound; take heed keep your dog on leed, your next.

Brad King does not deserve to head the SAO if he does not have the balls to take this to court.

I too am upset with the ruling in this case. It's not right. Holly had raised those dogs to be good citizens and To hear the man chuckled when he called 911 to tell him he had put his gun away...I am utterly discusted. I have a dog that weights 187 lbs., which is a lot of dog. People are always taken aback when they first see him. He is extremely gentle and thinks he is still a 20 lb puppy. I really think it is not the actions of these giant breeds that scare peole but their size. I think people figure because they are big they are mean. My heart goes out to Holly and her family.

Why does this decision made by Brad King and the State's Attorney office not surprise me. The system here will convict a dog for alledely killing a cat and deem him "dangerous". But give a person a gun, a dog or two that gets out of their yard accidently, and you have the right to shoot them because "you were in fear for your life". To be in "fear for your life" you have to be acted upon aggresively, I doubt this breed of dog showed any aggresstion. I am appalled to think people can discharge a gun outside their house in a residential area with childern in the immediate area and that is not a crime, would he have been liable if the gun had shot a human because he missed the dogs?? You can't shoot a person outside your home even if you are in "fear for your life". I am not understanding the laws, okay to shoot dogs that are running away but you can't shoot a human???? Where is the line here, seems this man crossed it and is just walking away free and clear, as the family moarns two members of their family that were murdered in cold blood.

Absolutely heart-rendering!!!!!!!!! After the police told this person NOT to go outside for his own safety, he grabs a gun, runs down the road--OFF PROPERTY--and shoots dogs that are running away??????????? And the DA in Marion County, Florida see nothing at all wrong with this?????? Some serious laws need to be changed in Florida and last I looked, Florida had the NUMBER 1 record of animal abuse resulting in deaths in 2009...69 cases reported. New York came in at Number 2 at 53. Governor Charlie Crist, you must be so proud!

I'm so sorry to hear about the MURDER of your two beautiful dogs. It discusses how how someone can fire a gun in to the streets of a neighborhood and get away with it. All he had to do was stay in his house until animal control arrived. That's their job to pick up animals on the run. This is a sad day for all.

This is horrible- As Dana mentioned, Karma will find its way to Brad King & the total worthless scumbag that shot Epic & Samson....As a mom to 2 Great Danes I can not imagine the loss you feel, Holly.... Our hearts are with you & your family.

All I can say is I am extremely disappointed in Brad King and the entire marion county court system for failing both of the dogs and their family. Especially failing the dog who was running away and shot in the back. Shame on you Brad King and the marion county court system.

I am soooo disappointed in Brad King and the entire marion county court system. This man,this coward,shot 2 innocent dogs,1 of which was running away so she was shot in the back,out of pure malice.He is a disgrace to human beings.He had every intention of killing these dogs when he made the 1st 911 call and yet he gets to walk around laughing at what he has done and how he was able to get away with murder,literally. What kind of message does this send to our children and anyone else out there "do whatever you want to animals there are no consequences".The dogs where not even in the mans yard.What about ALL the other witnesses who said they had seen even interacted with the dogs and that the dogs were in no way acting aggresive.Brad King and the entire marion county court system you should all be very very ashamed of yourselves for your lack of caring and concern if not for both dogs at the very least for the one who was running away and shot in the back.

I too am truly saddened that our justice system is no friend to our beloved animals, but it really isn't. I hope that will change. To the owners please take what consoliation you can in the fact that this man/scumbag that shot your beautiful dogs WILL, without a doubt, someday get his just rewards 10 times over because karma is a bitch. My heart goes out to you.

I can not believe how these court systems work, you can shoot to beautiful animals and get nothing. These are not just two dogs, no these are two members of a loving family. Would it be the same outcome if they were human? NO! Animals deserve the same respect as any human on the planet. How sad this is. Animals are a loving part of the world and should be treated as all other living creatures. I send light and love to the family of those wonderful dogs, many blessings to you all.
